Damage and Warranty Disclaimer
IMPORTANT: PLEASE READ CAREFULLY BEFORE ACCEPTING SERVICE
The purpose of this disclaimer is to clarify the responsibilities of both our company and you, the customer, concerning potential vehicle damage during roadside assistance services.
1. General Care and Liability
Our company and its contracted service providers are committed to providing professional and careful service. We will exercise reasonable care in the performance of all services, including but not limited to tire changes, jump-starts, fuel deliveries, and lock-out assistance. However, we are not responsible for any damage, loss, or expense that is not directly and demonstrably caused by the gross negligence or willful misconduct of our service provider.
2. Pre-Existing Damage
You, the customer, acknowledge and agree that you have disclosed any and all pre-existing damage, mechanical issues, or conditions of your vehicle prior to service. This includes, but is not limited to, scratches, dents, rust, broken parts, low clearance, or any other condition that may be aggravated by the provision of roadside assistance. Our company and its service providers are not liable for any pre-existing damage to your vehicle or for any damage that is an unavoidable consequence of a pre-existing condition. A visual inspection may be conducted by the service provider, but this inspection is not exhaustive and does not release the customer from the responsibility of disclosure.
3. Customer's Responsibility for Inspection
Prior to and upon completion of any service, you are responsible for inspecting your vehicle. You must immediately notify the service provider of any damage you believe occurred as a direct result of the service. Once the service provider has left the scene, the service is considered complete and accepted, and any claims for new damage may be rejected.4. Warranty on Parts and Labor
Unless a specific warranty is explicitly stated in writing on your service invoice, all parts and labor provided are sold "as is" and without warranty of any kind, either express or implied. Any applicable warranty on a part, if provided, is from the manufacturer and not from our company.
5. Limitation of Liability
In no event shall our company or its service providers be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, lost income, or loss of use of the vehicle, even if we have been advised of the possibility of such damages.
This disclaimer is a part of the service agreement and is deemed accepted upon your request for service. By accepting service, you acknowledge that you have read, understood, and agreed to this disclaimer.
